Patent Trial and Appeals Board Uphelds Patent Claims in the MEVIA Portfolio

EGLA Corp is pleased to announce that the Patent Trial and Appeal Board (PTAB) upheld patent claims of our streaming portfolio and has issued Final Written Decisions (FWDs) in two Inter Partes Review (IPR) proceedings initiated by Stingray Group Inc. and Stingray Music USA, Inc.

On December 20, 2024, Stingray filed IPR2025-00349, IPR2025-00350, and IPR2025-00351 challenging U.S. Patent Nos. 10,123,074 (‘074), 10,524,002 (‘002), and 11,140,441 (‘441). As of May 28–29, 2026, the PTAB has ruled in favor of the Patent Owner, upholding all claims of the ’074 patent and Claims 10–26 of the ’441 patent. A favorable decision is also anticipated on the remaining ’002 patent.

These proceedings involved extensive prior art challenges, with Petitioners citing approximately 28 references and combinations. Despite the significant resources committed by Petitioners, the PTAB — after full briefing, expert reports from both sides, and an oral hearing in March 2026 that the Patent Owner personally attended — confirmed the validity of the challenged claims.

Final Written Decision – U.S. Patent 10,123,074 The PTAB’s FWD in IPR2025-00349 upheld all 21 claims of the ’074 patent as valid.

This outcome materially strengthens the patents’ presumption of validity in the parallel district court litigation (Hernandez et al. v. Stingray Group Inc. et al., Case No. 1:24-cv-21226, S.D. Fla., and the related action in the Western District of Texas). The patent infringement counts in the Southern District of Florida remain stayed pending resolution of the IPRs, while the trade secret and contractual claims continue to proceed. A notice of the FWDs will be filed promptly with the district courts in support of lifting the stay on the patent claims.

Response to Petitioner Statements in the Record In Paper 29 and Paper 39 filed in IPR2025-00349, Petitioners made certain characterizations regarding the licensing discussions and the commercialization status of the ’074 patent. Specifically, the filing referenced a pre-suit demand letter and a post-suit demand exceeding $100 million, while asserting that the ’074 patent “has never been reduced to practice much less commercialized, so there has been no product to mark.”

These statements do not accurately reflect the full record. The original demand letter encompassed trade secrets, contractual matters, and patent licensing collectively. Moreover, EGLA Corp. has produced more than 20 GB of source code and technical specifications under a protective order — materials extracted from GitHub repositories and a functional device provided in connection with the Honduran operations. Publicly available information and EGLA’s commercial products, including those supporting the upcoming Mevia Music platform, further demonstrate reduction to practice and compliance with marking requirements under 35 U.S.C. § 287.

Next Steps and Outlook With the PTAB’s decisions, EGLA Corp. is well-positioned to advance its intellectual property enforcement efforts while continuing to innovate in advanced media streaming and delivery technologies. The company remains committed to protecting its innovations and pursuing commercialization opportunities through Mevia Music and related offerings.

The underlying litigation continues in the Southern District of Florida (with trade secret and contractual claims active) and the Western District of Texas. EGLA Corp.
